For scale: Worcester District Court alone filed more criminal cases in FY2025 than all five Cape and Islands courts combined. That's not bad news — it's the point. The off-season looks like the rest of rural Massachusetts: a smaller, steadier caseload of local matters through Barnstable's courts, where reputation and referrals matter more. A big share of summer cases — the borderline OUI stop, the beach-week disorderly, the shoplifting summons — never start with an arrest. They start with a summons to a clerk magistrate's show cause hearing, the stage where a charge can die before it ever becomes a criminal record. I wrote the book on winning them. Since June 1, 2026, show cause hearings in Massachusetts district courts are presumptively eligible to be held remotely.
That standing order (Joint Standing Order 1-26) quietly changed the economics of the Cape's visitor caseload: a defendant summonsed in Falmouth in July no longer has to fly back from Ohio in September for the clerk's hearing. Arraignments, evidentiary hearings, and trials still happen in person — but the single most winnable event in the case can now happen over Zoom. The firm whose website actually explains this to a panicked out-of-state visitor is the firm that gets the call. Almost nobody's website explains it. That's the opening.
